GURUGRAM: The Haryana Electricity Regulatory Commission decided on Wednesday, October 28, 2026, to stop further proceedings on Eleven Power Private Limited's parallel distribution licence for Gurugram and Nuh while state government directions remain operative. The new order changes the position following the commission's October 19 approval of a 25-year licence and is relevant to households and businesses awaiting another electricity supplier.

For consumers along MG Road, in Udyog Vihar and elsewhere in Gurugram, the decision concerns the proposed distribution arrangement across the revenue district. It is not a sector-wise maintenance shutdown notice. The commission's operative wording is conditional: it will not proceed for as long as the government's directions remain in force.

What the October 28 order decides

The signed order in Petition 30 of 2026 records written directions received from the Haryana government's Commissioner and Secretary on October 26. Those directions say that no parallel distribution licence should be created, operationalised or effectuated anywhere in Haryana.

HERC relied on Section 108 of the Electricity Act, 2003. As reproduced in the order, that section requires a state commission to be guided by written state government directions on policy matters involving public interest. It also gives the state government the final decision on whether a question concerns such policy.

The commission said the directions applied generally across Haryana and left no adjudicatory exercise for it to undertake in implementing them. Its conclusion was to take the matter no further while those directions remained operative. The order was issued in Panchkula by officiating chairman Mukesh Garg and member Shiv Kumar.

This wording matters for consumers comparing the latest decision with the earlier approval. The October 28 order does not describe the October 19 approval as permanently cancelled. It states a bar on further proceedings tied to the continuing operation of the government's directions.

How the application reached this point

The order sets out a short sequence after the earlier approval. On October 19, the commission allowed a parallel distribution licence for 25 years covering the Gurugram and Nuh revenue districts. It required the applicant to confirm acceptance of the licence terms within one week.

Eleven Power sent its acceptance on October 21. The commission says its next procedural step, after acceptance, was publication of the prescribed Form 6 public notice in English and Hindi publications circulating in the two districts. The latest order records that requirement as part of the licensing process.

On October 23, the company told HERC it was taking steps towards implementing the licence within the statutory and regulatory framework. It also asked for advance information and an opportunity to be heard about proceedings, applications, representations or other matters concerning the approval or licence.

  • October 19: HERC allowed the 25-year parallel licence.
  • October 21: the company accepted the licence terms.
  • October 23: the company sought advance information and a hearing opportunity.
  • October 26: the state government's written directions were communicated.
  • October 28: HERC decided not to proceed while those directions operate.

What remains unresolved

HERC rejected the company's request for advance intimation and a hearing. It reasoned that no proceeding was pending before it in which the company's rights were to be determined afresh. The commission therefore found no occasion for the requested hearing in giving effect to the statewide directions.

The operative decision provides no date for restarting the process or opening consumer applications. Consumers should follow the commission's official orders register for any subsequent decision. The October 19 permission alone should no longer be treated as evidence that a switch to the proposed distributor is ready to begin.
