HRERA Orders Rs 19.28 Lakh for Delayed Sector 82 Flat Possession

GURUGRAM: The Haryana Real Estate Regulatory Authority has ordered a promoter of a Sector 82 residential project to pay Rs 19.28 lakh as compensation to homebuyers for delayed possession, along with interest and additional amounts for mental agony and legal costs, according to an order reported on 14 September.

The decision was delivered by adjudicating officer Rajendra Kumar. Buyers Pravesh Datta and Shipla Singh, residents of New Colony, had booked a flat in the Sector 82 project in 2014 for Rs 1.26 crore. The promoter was to hand over possession by 27 July 2019. By July 2019 the buyers had paid Rs 77.14 lakh, but the flat was not delivered, the order narrative states.

HRERA rejected the promoter's delay-related arguments and directed payment of Rs 19.28 lakh compensation with 11 percent interest. The authority also ordered Rs 1 lakh for mental agony and Rs 50,000 towards legal expenses. The combination of delay compensation, interest and separate heads for hardship and costs reflects the adjudicating officer's reading of the buyers' payments and the missed possession date.

Sector 82 sits in the Dwarka Expressway planning belt where several licensed projects saw possession timelines stretch well beyond the dates printed in builder-buyer agreements. HRERA's Gurugram bench has in recent years used delayed-possession complaints to order refunds or compensation with prescribed interest where promoters fail to justify slippage.

In this matter the buyers had paid more than half the quoted consideration by the original possession deadline yet still lacked delivery years later. The adjudicating officer's quantified relief gives them an executable order rather than an open-ended wait for a revised handover date. Compliance timelines and recovery steps will follow the usual HRERA process if the promoter does not pay within the period fixed in the order.

Homebuyer forums in Gurugram often track such awards because they set practical benchmarks for interest rates and mental-agony amounts in similar Sector 82 and neighbouring project disputes. The 11 percent interest rate cited in the reported order aligns with the prescribed band used in many Haryana RERA compensation calculations.
