Court Stays Further Eviction at Baba Balak Nath Temple Complex

GURUGRAM: A district court has stayed further eviction action at the Baba Balak Nath temple complex in village Adampur Jharsa after an administrative demolition drive carried out on the directions of the Sub-Divisional Magistrate, and has ordered all parties to maintain status quo at the disputed site until the next hearing on 23 September.

The petitioner told the court that the family had been in possession of the land for about 30 years and that police and the administration had started eviction in an improper manner. Counsel alleged that idols were removed from the temple and that about 50 cows kept at the premises were shifted away during the drive. The lawyer also alleged that SDM Sanjeev Kumar had passed the eviction order beyond his jurisdiction.

According to the court narrative reported on 14 September, Sanat Pal Dayma purchased the land from Unitech on 4 August. A kalandra was filed on 12 August 2026, and the SDM office passed an eviction order on 27 August, within about 15 days. The court observed that a key legal question remains whether proceedings under the relevant section can decide ownership and possession of land. It summoned all related administrative records and documents from the SDM office at Badshahpur and barred changes at the spot meanwhile.

The demolition itself was carried out on Friday at the Baba Balak Nath temple in Adampur Jharsa near Sector 50. The operation lasted around 16 hours, with police closing approach roads to the temple. Mahant Balaknath Yogi, a legislator from Tijara in Rajasthan, visited to register protest. A mahapanchayat was held on Sunday.

Religious structures on contested land in and around licensed colonies frequently trigger clashes between revenue eviction powers and civil claims of long possession. By restoring status quo and calling for the SDM file, the district court has paused further bulldozer action while it examines jurisdiction and the speed of the August eviction order.

Residents of Adampur Jharsa and Sector 50 watched a heavy police deployment during Friday's drive. Temple committees and local groups argued that cattle and idols should not have been shifted before a full civil determination of title. The administration has treated the site as liable for eviction after the August order; that position now sits against the court's interim restraint.

Next week's hearing on 23 September will test how the summoned Badshahpur records explain the kalandra-to-order timeline and the SDM's authority. Until then, neither side is to alter the physical status of the temple complex and disputed land. Allegations that the eviction process was illegal or ultra vires remain for the court to decide and have not been finally adjudicated.
