SC Flags Gurugram Rain Collapse vs Planned Cities

GURUGRAM: The Supreme Court on Tuesday orally remarked that the city's urban system collapses during rains when basic infrastructure is not expanded in step with denser construction, and contrasted that experience with longer-horizon planning in Greater Noida.

The observations came from a bench headed by Chief Justice Surya Kant, with Justices Joymalya Bagchi and V Mohana, during a hearing on a plea against Karnataka's Premium Floor Area Ratio scheme. The court issued notice on the petition by the Citizens Action Forum and gave Bengaluru authorities four weeks to respond. It also clarified that additional FAR under the scheme should not be used to regularise illegal construction.

Chief Justice Surya Kant said there was no visible improvement in basic township infrastructure such as roads, sewer lines and related works despite extra construction capacity being sold. "We have seen in Gurugram how this system collapses if any natural calamity comes. Because, without adding to this infrastructure, you are burdening the size of the plot with multiple storeys," the CJI said, according to the courtroom account.

He said Greater Noida was different because it had been planned with the next 30 to 40 years in mind. The remarks were illustrative arguments about whether Bengaluru's roads, parking, water and power can support Premium FAR, not a separate case directing Gurugram agencies.

Premium FAR lets owners buy extra buildable area beyond the base ratio by paying prescribed charges. Petitioners argued that road width had become the main yardstick even as parking and utilities stay stressed. The Solicitor General, for the state, said overall additional FAR remained capped and that setback and parking rules still applied, with collections meant for a dedicated civic fund. He also assured the court that the scheme would not regularise unauthorised buildings covered by older regularisation drives.

Monsoon footage of stalled cars on MG Road underpasses and sector drains has become a recurring civic embarrassment. The Chief Justice's oral contrast with Greater Noida lands in that local conversation even though the operative directions in the case run to Karnataka authorities and Premium FAR safeguards.

Planners in Gurugram have heard similar critiques for years from residents' groups filing drain and sewage petitions. What is new is hearing the city's name used inside a Supreme Court FAR hearing as the example of densification without matching sewers and stormwater capacity.

For Gurugram, the practical takeaway is reputational and political rather than an operative local order: the city's rain-time drainage failures were cited at the highest court as a cautionary example while another state's vertical-growth policy was tested. Local agencies already face yearly monsoon scrutiny over drains, sewage and waterlogging. The bench's words add a national courtroom reference point to that debate without themselves mandating a new Gurugram project list.
