After full repayment or settlement of a home loan, the lender must return the original property documents and remove registered charges within 30 days under RBI's directions on personal loans. If a delay beyond that period is attributable to the lender, compensation is Rs 5,000 for each day of delay. The reason for the delay matters: the daily amount is not an unconditional payment for every late collection.
| Question | RBI rule |
|---|---|
| Normal deadline | 30 days after full repayment or settlement |
| Lender attributable delay | Rs 5,000 per day |
| Lost or damaged originals | An additional 30 days for the duplicate copy procedure |
| Applicability | Document release falling due on or after 1 December 2023 |
The rules come from the RBI circular of 13 September 2023, read for this explainer on 1 November 2026. Its coverage includes commercial banks, specified cooperative banks, NBFCs including housing finance companies, and asset reconstruction companies. This guide concerns property papers after repayment, rather than the calculation of an outstanding loan.
Home loan closure documents to collect: what RBI requires
The direction has two parts. The lender must release the originals it holds and remove the charges registered with a registry. A borrower checking closure therefore needs to establish both what has happened to the papers and what has happened to the registered charge. Receipt of a bundle of documents alone does not answer the second question.
RBI gives borrowers a choice of collection location: the branch or banking outlet where the account was serviced, or another office of the lender where the documents are available. That is a choice between the specified locations, not a promise that any branch can immediately produce the originals. The sanction letters issued from the effective date must mention the timeline and place of return.
As a practical record keeping step, compare the returned papers with the document list or acknowledgement from when they were deposited. Keep the repayment acknowledgement and correspondence about collection together. These are ways to record what happened in an individual case, rather than an additional statutory document checklist prescribed by this circular.
When does Rs 5,000 daily compensation apply?
If originals are not released, or the charge satisfaction form is not filed with the relevant registry, beyond 30 days after full repayment or settlement, the lender must explain the reasons to the borrower. Where the delay is attributable to the lender, the daily compensation rule applies. Establishing the repayment date and the cause of delay is therefore central to checking a claim.
For an arithmetic illustration, assume a lender attributable delay of eight days after the applicable deadline. Compensation at the stated rate would be 8 multiplied by Rs 5,000, or Rs 40,000. This example does not decide whether a particular dispute qualifies or count days before the deadline as compensable.
What if the bank loses the property documents?
For loss or damage, including partial loss, the lender must help obtain duplicate or certified copies and bear the associated costs. RBI allows an additional 30 days to complete that process. The delayed period penalty is calculated after a total of 60 days in those cases. The compensation provisions also preserve a borrower's rights to other compensation under applicable law.
The circular separately requires a published procedure for returning documents to legal heirs when the sole borrower or joint borrowers die. A family handling that situation should use the lender's stated procedure rather than assume that ordinary collection arrangements settle succession questions.
