Varanasi Court Orders FIR Against Three in Alleged Property-Lease Fraud

VARANASI: A chief judicial magistrate's court has directed Cantt police to register a fraud case against three people after a Varanasi resident alleged that documents were fabricated to lease family property and obtain a school licence.

The order was passed on a petition filed by Shailendra Kumar Verma of Kashmiri Ganj in Bhelupur, according to a report by Live Hindustan. The proposed accused are his sister Sushma Ratan, Neel Ratan and Nanda Ratan. Chief Judicial Magistrate Manish Kumar heard the application before directing police to record the case.

Verma's lawyers, Anuj Yadav and Naresh Yadav, told the court that his late father, Jitturam Verma, owned three buildings and that Verma and his sister were among the heirs. The complainant alleges that forged papers were used to show a lease over the property and that the documents were then relied upon in a licensing process connected with a school.

The court's direction to register an FIR is the beginning of a criminal investigation, not a finding that the allegations are true. Police will have to collect the original title and succession records, examine the disputed lease papers, identify who signed or submitted them and obtain the relevant licensing file. The people named in the petition are entitled to respond to the accusations during the investigation and in court.

Property disputes within families frequently move between civil and criminal forums. A disagreement about ownership, possession or inheritance may be decided by a civil court, while allegations of forged signatures, false records or dishonest use of documents can attract a separate criminal inquiry. The presence of a court-ordered FIR does not, by itself, settle who ultimately owns the buildings.

The case also raises an administrative question: what documents were examined when the school licence was sought, and whether the issuing authority independently verified the owner's consent. Those records will be important because they can establish when the alleged lease entered the official chain and who presented it.
